Miscellaneous Licensing Committee - 6 February 2026

**Approval of Minutes and Amendments**

The Committee first resolved that the minutes of the Miscellaneous Licensing Committee meeting held on 23 January 2026 were correctly recorded and should be signed by the Chair, subject to an amendment to the third paragraph of the “Reasons for Decision” on agenda item TOWN POLICE CLAUSES ACT 1847 & LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT 1976 – REVIEW OF HACKNEY CARRIAGE & PRIVATE HIRE VEHICLE DRIVER’S LICENCE – E1D217. The wording was changed from “attended a PACE interview” to “attended an informal interview”. A second resolution confirmed the minutes of the Urgent Driver/Operator/Vehicle Sub‑Committee meeting of 22 January 2026 as accurate and ready for the Chair’s signature.

**Fee and Charge Recommendations**

The Licensing Manager presented a report on proposed increases in fees and charges for hackney carriage, private hire operator and private hire vehicle licences. After discussion, the Committee noted the objections received and, on the motion of Councillor Cador and seconded by Councillor J Thomas, recommended to Council that the revised fee schedule be approved. A separate recommendation, moved by Councillor J Thomas and seconded by Councillor Batters, advised Council to adopt the amended “Licensing of Relevant Protected Sites – Fees Policy” document, which incorporates the agreed fee increases.

**Licence Applications – Refusals and Revocations**

The Committee considered two individual driver‑licence applications. For applicant CD295, the Committee heard the applicant’s statements and reviewed the report showing nine points on the driver’s licence and a historic offence on the DBS. Applying the statutory suitability guidelines, the Committee concluded that CD295 was not a fit‑and‑proper person and resolved to refuse the hackney carriage and private hire vehicle driver’s licence. In a separate case, the Committee revoked WD220’s licence with immediate effect under Section 61(2B) of the Local Government (Miscellaneous Provisions) Act 1976, citing three recent speeding offences, failure to notify the Council of nine penalty points, and the overarching duty to protect public safety.

**Other Procedural Matters**

The Committee deferred an unspecified application to the next Miscellaneous Licensing Committee meeting at the request of the applicant. It also resolved, on the Chair’s motion, that the press and public be excluded from consideration of certain business items that could disclose exempt personal information, in accordance with the Local Government Act 1972 as amended. These procedural decisions were recorded without objection.
